Terms & Conditions of Sale

By making a purchase from Skolnik Technical, you are agreeing to the following terms and conditions.

Payment Terms

Payment is to be made in advance of shipment by authorized Credit Card (Visa or Mastercard), Check or Money Order.  All sales are FINAL from purchase order date. 

 

Delivery Terms

All Skolnik products are thoroughly tested and benchmarked prior to shipment to guarantee out-of-the-box operation.  For delivery, please allow 6 weeks from date of receipt of customer’s complete payment.  All product shipments are processed via UPS and customers may specify their preferred UPS shipping method with the appropriate cost.   

 

Shipping

All products are shipped FOB Albuquerque, New Mexico to the Buyer's address, via UPS.  All Skolnik shipments are insured. Product shipment that weighs in excess of 100 lbs. will be shipped freight collect by a carrier at our discretion.  All shipments should be inspected immediately. If there is damage to the shipment, have the carrier make a written note of the damage. All damage claims must be filed by the consignee. Skolnik Technical will do everything possible to aid in this process.  However, our responsibility ceases when the carrier signs the bill of lading, acknowledging that they have received the merchandise in good condition.

 

Product Warranty

We warranty our products to be free from material defects in workmanship or materials for one (1) year from the date of shipment. If at any time within one (1) year after shipment, the product does not function as warranted, return it and we will repair or replace it without charge. This repair or replacement service does not include repair of failures caused by misuse, neglect, accident, modification, operation outside the specified operating environment, improper maintenance by the customer, failure caused by service of the product by non-authorized servicers, or failure caused by a product, including supply products, for which Skolnik Technical is not responsible.

If within thirty (30) days after shipment, the product does not function as warranted, Skolnik Technical will pay shipping charges to return the product to us for repair or replacement. After thirty (30) days, the customer pays shipping costs to return the equipment to Skolnik Technical.  Product returned to customer after warranty repair will be shipped via UPS Ground, with shipping paid by Skolnik Technical.

If any product is subject to federal or state consumer warranty laws, our statement of limited warranty included with the product applies in place of these warranties. Misuse, accident, modification, neglect, unsuitable physical or operating environment, improper maintenance by the customer or failure caused by service of product by non-authorized servicers or by an item, including supply items for which Skolnik Technical is not responsible shall void these warranties. This warranty replaces any other warranty, express or implied, including the implied warranties of merchantability and fitness for a particular purpose, and it is limited in duration to the 1-year coverage period.  No other warranties, expressed or implied, will apply after this period.

Limitation of Liability

If we default, or because of other liability you are entitled to recover damages from us, then regardless of the basis on which you are entitled to claim damages, we are only liable for the amount of any actual loss or damage up to the charges for the product or service that is the subject of the claim. This limit also applies to any reseller as the maximum for which we are collectively responsible. Under no circumstances are we liable for third-party claims against you for losses or damages, loss of or damage to your records or data, consequential damages (including lost profits or savings), incidental damages or other economic consequential damages, even if we have been advised of the possibility of such damages.

 

Not For Resale

Customer agrees to comply with all applicable laws and regulations of the various states and of the United States.   Customer agrees and represents that it is buying for its own internal use only, and not for resale.

 

Governing Law

This Agreement and any order issued hereunder shall be governed by the laws of the State of New Mexico. The parties hereby agree that any dispute relating to the Products sold hereunder shall be subject to the jurisdiction and venue of the City of Albuquerque, New Mexico and the parties hereby consent to such jurisdiction and venue and waive any obligations thereto.
